1. Scope
These Terms and Conditions apply to all agreements between Ghizlaine Bhihi / hi.photography, Rosenstraße 12, 59077 Hamm, Germany, and customers concerning photographic services, in particular wedding photography.
Individual agreements take precedence over these Terms and Conditions.
2. Conclusion of the Contract
An inquiry submitted through the website does not constitute a binding contract.
A contract is concluded when hi.photography expressly accepts the customer’s offer or when both parties enter into an agreement in text form.
The individual agreement determines the date, scope, location, price and services.
3. Services
The specific services are defined in the individual offer or agreement.
Wedding photography may include photographic coverage of the wedding, the agreed number of hours, editing and delivery of the resulting images.
Services not expressly agreed are not included.
4. Customer Cooperation
The customer must provide all information necessary to perform the services in good time.
This includes, where applicable:
- wedding schedule
- locations
- contact persons
- special programme items
- requested group and family photographs
- special photographic requests
Delays or changes to the wedding schedule may affect the ability to take certain photographs.
5. Fees and Payment
The agreed fee is stated in the individual offer.
Payment deadlines and any deposit are determined by the individual agreement.
Invoices must be paid within the agreed period.
6. Cancellation by the Customer
Cancellations must be made in text form.
Where agreed and legally permissible, hi.photography may charge for services already provided, documented expenses and an agreed cancellation fee.
The individual contract should specify the applicable cancellation terms.
7. Photographer’s Inability to Perform
If hi.photography is unable to perform the assignment due to illness, accident, force majeure or circumstances beyond its control, hi.photography will make reasonable efforts to arrange a suitable replacement photographer.
If this is not possible, payments already made for services that were not provided will be refunded.
Further claims are subject to the applicable statutory provisions.
8. Image Selection and Editing
The selection and artistic editing of the photographs are determined by hi.photography.
The customer receives the photographs in the agreed style.
Unless expressly agreed otherwise, the customer has no right to receive all photographs taken during the wedding or unedited RAW files.
9. Delivery
The photographs will be delivered within the period specified in the individual agreement.
The method of delivery, such as an online gallery or digital download, is determined by the individual agreement.
10. Customer Usage Rights
After full payment, the customer receives the agreed usage rights to the delivered photographs.
Unless otherwise agreed, the customer receives a non-transferable right to use the photographs for private purposes.
Commercial use, resale, commercial distribution or commercial modification requires prior permission from hi.photography.
Copyright remains with the photographer.
11. Publication by hi.photography
Photographs showing the customer or other identifiable persons will not be published solely on the basis of these Terms and Conditions.
Publication for portfolio, website or social media purposes will take place only where a separate consent has been obtained where required by law.
Consent may be withdrawn for the future. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.
12. Personal Rights and Third-Party Rights
The customer should inform hi.photography of any known circumstances that could prevent intended publication or use of photographs.
Where publication is intended, hi.photography will obtain any required consents where legally necessary.
13. Liability
hi.photography is liable in accordance with applicable statutory law.
No guarantee can be given that the assignment can be fully performed where circumstances beyond the control of hi.photography occur, including force majeure.
Liability for loss of digital image data is governed by applicable statutory law.
14. Storage of Image Data
hi.photography may delete delivered image data after a reasonable backup period unless statutory retention obligations require otherwise.
The customer is responsible for permanently backing up delivered photographs.
15. Data Protection
Personal data is processed in accordance with the Privacy Policy published on the website.
16. Consumers and Right of Withdrawal
Where the customer is a consumer and a statutory right of withdrawal applies, the applicable statutory provisions shall apply.
For service contracts, the right of withdrawal may expire under the statutory conditions, including where the service has been fully performed and the applicable legal requirements have been fulfilled.
If the customer expressly requests that the service begin before the expiry of a withdrawal period, the required information and declarations will be obtained separately.
17. Applicable Law
The law of the Federal Republic of Germany shall apply, subject to mandatory consumer protection provisions and excluding the UN Convention on Contracts for the International Sale of Goods where legally permissible.
For consumers, this choice of law shall not deprive them of mandatory protections applicable in their country of habitual residence.
18. Place of Jurisdiction
For consumers, the statutory places of jurisdiction apply.
Where the customer is a merchant, a legal entity under public law or a special fund under public law, the registered place of business of hi.photography shall be the place of jurisdiction to the extent legally permissible.
